By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to any part of the terms, then you may not access the Site. 

This agreement is a legally binding contract between you and Cosimo Construction LLC.

  1. Website Use

The Site is provided for your personal, non-commercial use to provide information about our construction services, including roofing, siding, fencing, and metal structures. You agree to use the Site only for lawful purposes.

You cannot:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works, transfer or sell any information, software, products or services obtained from the Site.
  • Use the Site in any manner that could damage, disable, overburden or impair the Site or interfere with any other party's use and enjoyment of the Site.
  • Obtaining or attempting to obtain any materials or information through any means not intentionally made available or provided through the Site.
 
  1. Intellectual Property Rights

All content on this Site, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Cosimo Construction LLC or its content providers and is protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of Cosimo Construction LLC.

 

 

  1. Quotes and Services
  • Free Inspections: We offer free, no-obligation inspections and quotes. A request submitted through our website does not constitute a binding contract for services.
  • Information Accuracy: You are responsible for providing accurate information (name, address, project details) when requesting a quote. Quotes are based on the information provided and a physical site inspection.
  • Service Agreement: Construction services will only be performed after a written service agreement is signed between you and Cosimo Construction LLC, which will detail the scope of work, materials, costs, and timelines.
  • No Pago Inicial (Down Payment): Our policy of not requiring an upfront payment is subject to the terms specified in the final service agreement. For large-scale projects (over $50,000 USD, according to the transcript), progressive payment terms may apply, which will be clearly stipulated in said agreement.

  1. Warranty

Cosimo Construction LLC offers a five (5) year workmanship warranty on completed work. The details, limitations, and exclusions of this warranty are provided in writing in the final service agreement. This warranty does not cover damage resulting from natural disasters (hurricanes, tornadoes, hail), owner negligence, vandalism, or material failures covered by the manufacturer's warranty.


  1. Referral Program

Our Refer Your Neighbor program offers a $250 USD bonus for referrals that result in a completed and fully paid service contract. Cosimo Construction LLC reserves the right to verify the validity of the referral and to modify or cancel this program at any time without prior notice. Payment will be issued after the referred customer has fully settled their invoice.


  1. Exclusion of Warranties and Limitation of Liability

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." COSIMO CONSTRUCTION LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COSIMO CONSTRUCTION LLC WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE OR ANY CONTRACTED SERVICES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.


  1. Links to Third-Party Sites

The Site may contain links to third-party websites (for example, our financial partners). These links are provided solely for your convenience. We have no control over the content or privacy policies of these sites and assume no responsibility for them.


  1. Compensation

You agree to indemnify, defend and hold harmless Cosimo Construction LLC, its directors, employees and agents, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site using your Internet account.


  1. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without giving effect to any principles of conflicts of law. Any dispute arising out of these Terms or the use of the Site shall be resolved exclusively in the state or federal courts located in Hidalgo County, Texas.


  1. Modifications to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will attempt to provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.
